Man posts girlfriends’ X-rated videos on PornHub

Senior Parish Judge Lori-Anne Cole-Montaque has vowed to set the correct judicial precedent for cybercrimes, after a Corporate Area man pleaded guilty to posting sexual videotapes and pictures of his girlfriends on pornography website PornHub.

The identity of the defendant will not be published to protect the identity of the complainants. He pleaded guilty to two counts of use of computer for malicious communication. It was shared in the Kingston and St Andrew Parish Court on Thursday that the defendant was in a relationship with two women, one of whom was his fiancee. He recorded videos in which he engaged in sexual intercourse with the women and had nude photographs of them. The court heard that the defendant posted the illicit videos and photographs on the website.

"Their faces were not showing. It's a private site," the defendant told the senior jurist when asked the reason for publishing the photographs and videos.

"I think I know where your Christmas will be spent. What a mean spirit thing to do!" the judge scolded him, followed by murmurs of disgust by members of the public in the courtroom.

The prosecutor indicated to Cole-Montaque that posting lewd content was a hobby of the defendant, as he previously recorded sex with other women and had posted it on PornHub. Those women, the court heard, have not laid charges against him.

"When the complainants asked him to remove the videos, he said he was not going to remove them until he gets paid by PornHub," the prosecutor said.

PAYMENT REQUIREMENTS

Individuals are paid by PornHub when they register to the platform's Amateur Model Programme and begin to upload sexual content. According to PornHub, "persons earn a substantial cut of the advertisement revenue generated by your videos. The rate you get paid depends on the performance of your video (views + ratings)".

The defendant, who is the father of two daughters, said he has since removed the videos and sought to apologise for his actions.

"You are not going home today. He is a menace, young women are not safe with your little fingers. I have to make sure that when I am passing sentence, that the deterrent effect is felt. This offence is becoming too common-place," Cole-Montaque noted.

The defendant, when asked by the judge, indicated that he had sisters and would not be happy if a man had posted sexual content of them.

"Well I have to make sure that the justice you would want for your sisters and daughters is served on you too. Same knife stick sheep, stick goat. You are remanded in custody," the senior judge stressed.

The defendant is to compensate each defendant in the sum of $200,000 and is to begin payment when he returns to court on December 18. He was also made the subject of a fingerprint order.
