Bail extention for distributing porn
A man accused of distributing sexually explicit images of a woman without her consent had his bail extended in the Corporate Area Resident Magistrate's Court last Tuesday.
Charged with unlawful access to computer data and obscene publication is David Moffet.
Allegations are that Moffet had a dispute with the complainant, who was his girlfriend. It is said that things came to the point of no return when Moffet damaged the complainant's cellular phone, making off with the SIM card and memory card.
It is believed that Moffet subsequently rifled through the content on the complainant's memory card and found a number of sexually explicit images and distributed them via different media.
Moffet's alleged actions, popularly referred to as revenge porn, was presumably executed as a means to publicly humiliate his ex-lover.
Moffet offered his defence in court.
"We did have an argument and she did mash up my phone, and mi mash up back her own," he said, adding that he was oblivious as to how the revenge porn allegations arose.
The complainant, however, maintained that Moffet made off with her memory card, which resulted in the explicit images surfacing sometime later.
"Your Honour, him have a phone, and it is coming from his number. The pictures are being sent from his number," she explained.
Resident Magistrate Maxine Ellis ordered Moffet to return to court on January 22 as a report from the police's Communication, Forensics and Cybercrime Unit is outstanding.
