X-rated WhatsApp video lands woman in court
A St James woman has found herself before the St James Parish Court for reportedly posting a video on social media depicting a former friend in a sexual situation.
Brandy Whyte, who is charged with malicious communication, will return to court on February 21 and was bound over to return, when she appeared before presiding Parish Judge Kaysha Grant-Pryce on Wednesday. The court was told that, sometime last November, Whyte posted a video on WhatsApp that depicted the complainant in an intimate situation. When the complainant found out, she reported the matter to the police.
When cautioned by the police, Whyte reportedly said, "A she first expose me by posting a video, and mi retaliate." She was subsequently arrested and charged.
During Wednesday's court proceedings, Whyte's lawyer, Adrian Dayes, told Grant-Pryce that he wanted partial disclosure of documents from the prosecution, and that the situation between Whyte and the complainant could be easily resolved.
"We are not going to waste time on the particulars, but suffice to say, I'm going to ask for partial disclosure. Given the posture of the defence where we indicated that, even on the issue of service, the Crown's plaintiff cannot be trusted, we take the same posture on the utterances that are alleged," said Dayes. "So far, our instructions seem to be putting the Crown to task...these are friends with issues that can be resolved."
"Well, friendships these days go hard," Grant-Pryce quipped.
Meanwhile, the prosecution indicated that its disclosure of documents could be made to Dayes by January 28.
